Terms of Service

1. Acceptance of Terms

By accessing or using Potato ("Service"), you agree to these Terms of Service. If you are a school administrator accepting on behalf of your institution, you represent you have authority to do so. If you are a parent accepting on behalf of your child, you represent you are that child's parent or legal guardian.

2. Children and Schools

Potato is designed for K-12 students. Students under 13 may only use the Service with parental consent or through a school that has obtained such consent. Schools are responsible for:

  • Obtaining appropriate parental consent before enrolling students
  • Ensuring students use the platform in accordance with school policies
  • Monitoring in-platform activity using the provided teacher dashboard
  • Notifying us of any safety concerns involving students

3. The Service

Potato provides an AR/VR gaming platform for K-12 schools, including: curated games, a game creation studio, school-controlled multiplayer, teacher admin tools, and curriculum-aligned game content. The platform operates as a closed network — students interact only with verified classmates and school staff.

4. Acceptable Use

You may not use Potato to:

  • Harass, bully, or harm other students or users
  • Attempt to bypass the school network restrictions
  • Share violent, explicit, or inappropriate content
  • Attempt unauthorized access to other accounts or system components
  • Use the platform for commercial purposes without written permission

Violations may result in account suspension and notification to the school.

5. School Subscriptions

Access to Potato requires a school subscription. Pricing is based on student count and plan tier. Subscriptions are annual unless otherwise agreed. Early access schools receive founding pricing locked for the duration of their subscription. Contact hello@potato.xyz for pricing questions.

6. Student-Created Content

Students may create games and content within the platform. Student-created content is owned by the student (or their parent/guardian). We do not claim ownership of student creations. Schools may set policies governing whether student content is retained after a student leaves the school.

7. Intellectual Property

The Potato platform, game engine, built-in game library, and all associated branding are owned by Lunchbox EdTech Inc. Schools and students receive a limited, non-exclusive license to use the platform during their active subscription.

8. Limitation of Liability

To the maximum extent permitted by law, Potato is not liable for indirect or consequential damages. Our total liability for any claim shall not exceed fees paid in the 12 months prior to the claim. This does not affect liability arising from gross negligence or willful misconduct.

9. Termination

Schools may cancel their subscription with 30 days notice. We may suspend access immediately for material breach. Upon cancellation, schools may export student data within 90 days.

10. Governing Law

These Terms are governed by New York State law. Disputes shall be resolved in courts located in New York County, NY.
